uhhh - well basically guys I just had this debate on a thread like a month ago - so I'm not going to really jump into this one - just don't expect a follow up - just giving some food for thought -
Obviously there are serious problems with the implementation of the death penelty - mostly because the defense attornys are public defenders strait out of law school who are not equiped to handle cases of such magnitude. Mistakes are made and it is possible for the innocent to be executed.
But as far as the theory - ie is capital punishment wrong
- I would say simply this. To say it is wrong is very easy when violent crime has not touched your life - when it is not more than an academic issue. It is convenient - it makes us feel rightous to condem capital punishment -
But what if your mother was raped and murdered? How would you feel? What would you consider justice? If your mother's killer was in jail, alive, eating, excersizing, watching TV - would you be satisfied?
Would you have any interest in seeing this person reformed?
Would you feel the criminal justice system had served you? Would you want to take justice into your own hands?
You see the answer is not so simple.
Let me paint a picture - and rebut an earlier arguement. On trial right now in California is a man who methodically kidnapped women, chained them in his basement, tortured and raped them for weeks before killing them.
It is beleived he may have done this to as many as 9 women. Try to imagine what these women went through before their lives, the only they will ever know, was stolen from them. What do you consider justice - A life in prison? How is that just? Please explain the justice. He gloried in their pain how is it justice for him to spend his time watching TV and getting 3 squares a day on the tax payers dime.
Is Descartes suggesting that murderers be executed in the manner of their victims ? - because eye for an eye really would be weeks of torture then brutal murder - instead of lethal injection.
Knowing the exact time of your execution I think is better then being chained in a basement and not knowing - just existing in a thrall of fear.
Lastly - get over this silly idealogical debate about 'messeges to society'
We are not talking about a social movement - these are not terrorists with a common ideology who look upon their fallen comrades as myrters.
We are talking about a few sick individuals - cold blooded first degree murderers. They are mentally unstable, have diminished conscience and violent tendancies - this has nothing to do with 'the messege the government sends' - it has more to do with the fact that every buschel has its bad seeds.
It is natural that people should be repulsed by capital punishment - it is a grim bussiness - but be realistic - it is often a grim world - especially for the victims of violent crime.

If you check into it you will find that it is cheaper to
pay for someone to stay in prison for the rest of their life
than it costs to murder them. And think about who has to pay for these things. We do.

a different solution

I don't think that as a human being we shoud a be able to decide whether a person lives or dies, but a criminal does have to be punished for doing wrong.
I feel that the prisons in the united states have become too relaxed, and why should our tax payers pay for a criminal to sit around, have gyms, tvs, and all of the luxeries that good people work so hard to have? I think that if they could work so hard to hurt another, then they should be working to help them while they are doing their time.
No the death penalty is not right; its way to harsh for anyone. But I can see both sides of the issue. I can't help but understand how the people's families must feel about the person that raped, killed, and terrorized their families lives. I would have a hard time not wanting the ultimate sacrifice from them too if this happened to someone I loved. To those people I'm sure in time they would change their minds about wanting to continue the death cycle, but at that first crucial time...all they want is closure and to kinow that their loved one didn't die for nothing

If a person has done terrible things to others, terrible things should be done to him. That is justice. If say, you conduct a gruesome murder, or worse, a rape and a murder or multiple murders or some stupid un acceptable reason (personal gain), you should not be able to get away with just saying "sorry and I am repenting". That would be stupid. There should exist a punishment which is proportional to the kind of conduct. If the crime is too gruesome and if the criminal is so maniac that he is bound to do the bad things again once he is released, he should be killed.
All arguments against death penalty would hover around saying that law could be wrong. Then strengthen law. But punishments should be in proportion to the crime that has been commited and for bad crimes there should be bad punishments.

I understand luke's point about how one would feel if they were the victim or closely related to the victim. as i have never been in that situation, i can't truly say. my main problem with the death penalty is that in a lot of the countries where it is administered, sometimes innocent people are dying. i'm sure a lot of you remember the whole ordeal in the u.s where a man was on death row and just before he was about to be killed, it was discovered that he was indeed innocent and that they would have been murdering an innocent man.
i believe that a person's punishment should be proportional (as decided by the judge and jury) to the crime they committed. if they did something really bad, they get more time in jail. i just refuse to believe that the only thing we as a race can think of to combat evil and immoral sins is death
