British troops are not protected by human rights laws on the battlefield

Today, the Supreme Court has ruled that British soldiers serving on foreign soil are not to be protected by Human Rights laws outside of military bases.
Advocates of Pte Jason Smith, who died of heatstroke caused by temperatures exceeding 50C whilst on a mission in Iraq in June 2003, still see this ruling as a major legal and moral setback.

But do people of Iraq are protected by the Human Rights Law? During the summer there is no electricity, while it is hot (about 60C degree); and also no clean water in many places..
Soldier is soldier and he should serve in difficult conditions..
But what should we say when children suffer or even die in such conditions were caused by the war?
