Can George Bush, Dick Cheny and Donald Rumsfeld be considered war criminals?

In my social justice and human right law class we spent a lot of time talking about whether it would ever be possible for George Bush, Dick Cheny and Donald Rumsfeld to be tried as war criminals for war crimes, crimes against humanity and crimes against peace, particularly related to the 2003 invasion of Iraq. Obviously trials of this kind would have to wait until the "conclsion" of the ongoing US military involvement in Iraq, however it has been an issue brought to Belgian and German courts (one of the main reasons why these nations have since amended their universal jurisdiction laws).
While the invasion of Iraq is almost indisputably recognized as being illegal, whether the War in Iraq meets these other criteria is hotly debated. What are your thoughts?

I believe they all should be tried as war criminals,but just like President Nixon and others, They tend to exonerate each other in the end. Regarding this matter, Obama has said,"We should look forward not backward". I think he is wrong. Everyone should be held accountable for their actions. It is as Ghandi said: On things that will destroy us...Politics without Principle, Wealth without Work, Business without Morality, Science without Humanity and Worship without sacrifice...He is my hero
