Well said. I would expand on this in saying that the very name of the doctrine is founded on an ideology of "rights". Rights are granted by one who is in a superior position that permits the granting of such rights to one who is not necessarily in a position to claim them. So when you say paradox, I would certainly agree. The very existence of life on this little planet is paradoxical, it is against the odds. But add to that the way humanity has evolved and shaped the planet, how the Wests movement for a global empire has become idealized under the flag of globalization, the glorification of the western version of "Liberty"... and it is clear how we are in need of some clarifying code, if nothing else but to declare the Western idea of righteousness. Because of the fact that the UDHR was essentially made by the US, is not truly Universal, and this is because the "Rights" are subjective and as you said, El Alaoui, cultural relativity is of utmost importance when creating a declaration deemed Universal. A vast majority of cultures weren't even present in the making of the Declaration, which makes it difficult to uphold in any realistic way.
The UDHR was made with a visionary style common to the United States, idealist through and through.
Though it is built to address pressing and horrific issues, it presents no action plan and reacts like a code of ethics, similar to the US Constitution, which may or may not be upheld depending on who's looking at the time.
I would encourage anyone who reads this to write back and let me know what you consider your basic rights, self-proclaimed and not handed down to you by a figure of authority. What values do you have and how do you live them?

UN anti-blasphemy measure a threat to free speech, critics say

Steven Edwards, Canwest News Service Published: Tuesday, November 25, 2008

UNITED NATIONS - Islamic countries yesterday won United Nations backing for an anti-blasphemy measure that Canada and other western critics say risks being used to limit freedom of speech.

Combating Defamation of Religions passed 85-50 with 42 abstentions in a key UN committee, and will enter into the international record after an expected rubber stamp by the plenary later in the year.

But while the draft's sponsors say it is aimed at preventing violence against worshippers regardless of religion, religious tolerance advocates warn the resolutions are being accumulated for a more sinister goal.

"It provides international cover for domestic anti-blasphemy laws, and there are a number of people who are in prison today because they have been accused of committing blasphemy," said Bennett Graham, international program director with the Becket Fund, a think-tank aimed at promoting religious liberty.

"Those arrests are made legitimate by the UN body's (effective) stamp of approval," said Mr. Graham.

Passage of the resolution is part of a 10-year ACTION PLAN the 57-state Organization of the Islamic Conference launched in 2005 to ensure "renaissance" of the "Muslim Ummah" or community.

While the current resolution is non-binding, Pakistan's Ambassador Masood Khan reminded the UN's Human Rights Council this year that the OIC ultimately seeks a "new instrument or convention" on the issue. Such a measure would impose its terms on signatory states.

"Each time the resolution comes up, we get a measure of where the world is on this issue, and we see that the campaign has been ramped up," said Hillel Neuer, executive director of the Geneva-based monitoring group UN Watch.

While this year's draft is less Islam-centric than resolutions of earlier years, analysts note it is more emphatic in linking defamation of religion and incitement to violence.

That "risks limiting a broad range of peaceful speech and expression," Mr. Neuer argues.

The 2008 draft "underscores the need to combat defamation of religions, and incitement to religious hatred in general, by strategizing and harmonizing actions at the local, national regional and international levels."

It also laments "Islam is frequently and wrongly associated with human rights violations and terrorism."

But western democracies argue that a religion can't enjoy protection from criticism because that would require a judicial ruling that its teachings are the "truth."

"Defamation carries a particular legal meaning and application in domestic systems that makes the term wholly unsuitable in the context of religions," says the U.S. government in a response on the issue to the UN High Commissioner for Human Rights.

"A defamatory statement ... is more than just an offensive one. It is also a statement that is false."

Canada and other western countries emphasize the distinction between granting an "idea" rights -- and defending the right of people not to be discriminated against.

"Canada rejects the basic premise that religions have rights; human rights belong to human beings," said Catherine Loubier, spokeswoman for Foreign Affairs Minister Lawrence Cannon.

"The focus (here) should not be on protecting religions, but rather on protecting the rights of the adherents of religions, including of people belonging to religious minorities, or people who may choose to change their religion, or not to practise religion at all."

Muslim countries say they are only trying to cut down on what they see as extensive bias against Islam in the West.

But supporters of the western position say the resolution and its Predecessors contribute to increasing discrimination based on religion.

"From the human rights side of things, this is the opposite of what is supposed to be happening," said Becket's Mr. Graham. "Instead of protecting an individual, this resolution protects an idea, and relies on hurt feelings as a source of judgment. It can only lead to a jurisprudence of hurt feelings."

Canada says governments have abused laws against defamation or contempt of religions to "prosecute and imprison journalists, bloggers, academics students and peaceful political dissidents."

The Iranian parliament, for example, is currently weighing a draft Amendment to its penal code that would impose capital punishment for apostasy.

But in an irony given Canada's stance, an anti-blasphemy law remains in the Criminal Code. Experts point out it has not been used for a prosecution in more than 70 years.

What is this 'hate' anyway?

'Hate' is just a condition of perpetual anger; if the anger is justified and the illegal conditions which cause it continue to exist without ending, and with no solutions, apologies, nor reparations being offered, what do you expect? Oh, wait: Liberal (explicit language removed) (well, governments in general, really; the usual self-serving, hypocritical Salesmen) actually seem to think (or pretend) that they can 'ban' this very basic human emotional response TO injustice, thus attacking the symptoms as an eternal "crisis" while pretending to 'manage' the initial problems - instead of actually solving them.

Funny how we already had laws against slander & libel for this sorta thing, eh? This sorta sh_t just strengthens government oppression while kow-towing to Muslim sentiments (i.e: the fake 'right' to not be offended - even by the facts and the objective truth).

Religion' is just codified superstition: unproven, unproveABLE stories made up by other people. As such, these many stories are entitled to NO special protection under any laws; it would mean making laws to protect lying and nonsense from examination and investigation. It would mean the cowardly, hypocritical, "politically correct" suicide of our ability to think and reason.

Oops. I'm WAAY too late, aren't I? Societies' "bad;" it hypocritically imitates paranoid, restrictive and oppressive Islam, even now! We are all ruled by sell-out hypocrites; SALESMEN.

I don't respect delusive superstitions, especially when their allegedly 'holy' book hypocritically demands world conquest by violence and stealth (whichever works best at any given time), and commands forced conversions, slavery if the forced conversion is resisted, and death if the slavery is resisted.

I don't understand why our allegedly secular, so-called 'governments' claim to 'respect!' this literally self-destructive insanity - & pass laws forcing US to.

I am really disturbed because though it started as war against inequality and injustice, it has turned into high level witch-hunt between the "Haves" and "Have-Nots". On one hand the well able have amassed themselves to consolidate what they have and have ganged up to secure anything up for grabs as long as they can get their hands into it. It has become a safe haven to get affiliated to the strong since it appears that they are above common jurisdiction. In my country we always have this segregation politically, socially and economically. For example, it is amazing to look at inhabitable slums and posh estates staring directly opposite each other while they are separated by a 20 feet tarmac. Same case has applied to other issues in other regions though in greater magnitude. Palestinians and Israelis have lived together for as long as history can trace. External manipulation - disguised as protection of the right to independence for sovereign nations has torn the world into two. Even the so-called 'non aligned movement' member states silently side with either side. Capitalism and Communism has led to equally devastating consequences. The United States vs Cuba. The first world countries are so deep into each other that they cannot plunder another individually. I am not against strategic alliances but I think they are the most beneficial yet the most dangerous potential hazards. Human rights as a package in this equation is misplaced. The strong cannot let go and the weak pursue the wealth so badly to no avail. I strongly think that a similar assembly similar to the UN should be worked out to address these inequalities and protect humanity from extinction. We are living at the mercy of the strong. This insinuates that they can terminate our livelihoods without our consent but did not decide on whether we should exist. This war can only be won when we actively invoke positive attitude towardss justice & equality.

The Universal Declaration of Human Rights celebrating its 60th year in existence, means 'Freedom'.

Short and sweet. It is most definitely a celebration, a recognition of the development of people as a whole. It celebrates what we take for granted, the very idea that I can speak freely here on this forum without the scrutiny of people around me. It means that I can walk freely and that my children can walk freely, my grandchildren and there on after. It is a promise to those suffering under a corrupt regime that there is hope and that one day they too will share these rights. It is a promise to children in Africa that one day they will not die because landmines litter their play ground or that they are of a certain religion.

More importantly though this 60th anniversary is a reminder of how much more we can do, how much more injustice there is in the world. It tells us to wake up again, a gentle reminder to uphold these rights with all that we have.

Past this 60th anniversary we are currently going through some of the worlds worst times. Beyond the economic downfall that hit the world in multiple places throwing people in a cycle of poverty. We are experiencing war between the Israelis and the Palestinians, killing countless innocent bystanders. We are experiencing murder in Sri Lanka where hospitals are being attacked. We are experiencing deaths through a perventable disease of Cholera in Zimbabwe.

As much as we should celebrate our achievements, perhaps we should save the cheering for later. Later when children in Zimbabwe can cheer with us, or when the citizens of Pakistan can cheer with us, then we can cheer.

How is the UN and the declaration a clebration?

It’s the bane of our existence.

The UN is a compromised organization which has been subverted into being the bureaucratic organ for the spread of transnational collectivism….complete with its degraded set of civil entitlements (human rights).

Sure I'll agree with the UN at one point in time being meaningful but it's more like One-Way Multiculturalism now.

That UN charter is very reminiscent of Canada’s own Charter which holds freedom of expression up as a “fundamental” right - a right which is then negated by one of those handy laws Article 29 refers to - ie. Section 13 of the “Human Rights” Act.

Time to pick up our coats & leave the UN to its Monsterious ambitions. Its become nothing more than an Islamic society for the domination of Islam on the world.
