Human Right Violations in Germany: NoFreedom of Opinion, Information, Association, Family Life and Right to Fair Trial
Violation of Article 8 (Family life)
freedom of opinion was violated
Germany was condemned because of violations of freedom of opinion and freedom of association by the European Court of Human Rights. But the German courts seem not to respect this judgement 4 and try to continue as before:
Germany is the only country in Europe, which reserved the right not to comply with CoE Recommendation (85) 13 of appointing an independent Ombudsman. The ombudsman was recommended the general competence, to the human rights matters under his scrutiny and, if not incompatible with national legislation, to initiate investigations and to give opinions when questions of human rights are involved.

Okay, I can understand there are some strong emotions at work here. Anytime children are taken away from their family for their "safety" by officials from a youth agency, one can only expect the family to protest vigorously.
Words like "kidnapping", " torture", "no democracy" are obviously eye-catching and that is why they are being used here.
But a more realistic, dispassionate consideration of the situation is called for.
No doubt there are situations when youth agencies, or "Child Services Departments" as they are called in America, do overstep their authority and take children away from families in which they were not really in danger. This is true of such government agencies ALL OVER THE WORLD, not just in Germany.
It has to be said that such children's protection services are a vital necessity in ANY society. Children should be protected, even from their own abusive parents if necessary. One hopes that there are enough legal safeguards in place to overturn any overreaching by such youth agencies.
I have read many of the above cited homepages (most are in German) and there are some "hair-razing" cases which do seem to be cases of overreaching by the youth agency officials. Taken together, however, the cases seem to be small in number, certainly not the "10 million" figure suggested in the TIGblog cited above. I think one also must say that the vast majority of youth services officials try to do their jobs properly and it is unfair to paint them all as "torturers" and other such terms.
Germany is a democracy with a well-developed legal system and I hope any injustices will be remedied. Any other claim is just a smear.

whilst i too would like more details, to say that HUMAN RIGHTS are not violated in the WESTERN COUNTRIES are rubbish !!! people in western countries who are poor dont have justice in these "well-developed" legal systems:

if i can give advice, we are living in a fast food society, and get overloaded with information. people tend to tune out even on the internet.
if you want to get a message out you need to press your points in fewer paragraphs.
sometimes its unavoidable BUT emotive language doesnt help.
most people just need the facts. and the laws
One paragraph is ideal and i think 3 max !!

One last point, The Australian Prime Minister Kevin Rudd just apologised to Australian Aborigines for stealing their children. Thats something you can use in your cases and petition to the HUMAN RIGHTS COURTS.
Some australians argue that taking children away from poor or abusive parents actually helps them.
I dont know any of the European cases so i cant decide either.
But I will always support people who want the right to challenge State actions in the Courts !
ACCESS TO THE LAW IS PARAMOUNT !!

As I stated in my first post, I am sure there are instances of abuse by the Youth Agency. As I said, I read most of the links you suggested (I not only speak German, I am very much up on German history and dealing with the German bureaucrats) and there were many suspicious cases.
I personally have had experience with German bureaucratic stubbornness and know it can be very frustrating. I had incredible trouble trying to get married to my Japanese wife. Since I had entered Japan as a German citizen, I had to get a letter of permission to marry from Germany. The German authorities decided they wanted to investigate my wife's past and re-try two of her (Japanese court decision!) divorces in a German court. It was such a fiasco, my visa to stay in Japan ran out and we had to fly to the USA to get married.
But I would never say that Germany is not a democracy. Please try to make your case reasonably. You should also suggest a course of action for TIGgers to take which would help your cause. I guarantee trying to shame or embarrass the German Youth Agency is not going to accomplish anything.

hi, i think people should inform themselves before they discuss here as Germany is not a democratic country and was never.Germany, killes and steals children and why do you think there are alot of germans applying for refugee status around the world?? Holocaust was there, is there and will always be there.
Remember, those days when Hiteler asked his people (you guys want total war) All said YES!! and when the world accused Germany for that no one was responsible for that except HITLER, Oh come on!!!!!
Germany violates human rights and manupulates people and those who says germany has a good system he too is manupulated and i think he or shw can not help me stop violations in germany instead he says YES to the human rights violations there!! He who ignores the truth is a member of those who violates human rights
