Non-human animals' rights
June 26, 2005 - 02:03 AM

What are peoples' opinions on this?

My main questions are

Should animals have the same rights as humans?
Should ALL animals have rights, like bugs etc, or only mammals, or only those that feel pain?
Should the land have rights, too-or should we confine these rights to humans?

A couple of questions come to my mind:

What rights should animals or land have? Would they be the same as humans?

How do animals state or invoke their rights?

Does giving animals or land rights diminish human rights?

in Law.. even if you are human, the law of contract certifies certain rules about entering into contracts... some of them pertain to the eligiblity of a person to enter into contracts like the person should not be a minor, should be of sound mind and not be convicted.

Sound mind would be someone capable of understanding what he/she is getting into and is free of undue influence... blah blah.

Rights of a minor is different to rights of a convict or a person of unsound mind... not entirely, but certain deviations are made in order to protect them and everyone else's rights.

so technically will an animal be able to enter into a contract?

I guess everyone should have rights & laws to protect those rights.... but animals and humans having similar rights?.. i dunno, maybe it would and should vary.

I think animals that feel pain should have a right to be protected from unnecessary suffering. I realise this is a bit vague and fluffy but that is the main gist of what I want to get across.

Yes, it's a bit vague, but not fluffy. It's vague and quite difficult because then there would be questions of who determines "unnecessary suffering" and degrees of pain; it could be subject to cultural and/or religious debates. However, personally, I think animals should have specific rights that would protect them from exploitation (zoo, circus, animal testing and experiment) and that would provide decent living conditions for continuous breeding.

Rights tailored?
June 28, 2005 - 06:48 AM

Obivously they shouldn't have political rights etc but I thought-stuff that means that humans can be prosecuted for causing unnecessary suffering to animals in the same way as unnecessary suffering to other humans.

Land should be protected in some way...like you lose all this valuable swamp etc for development, but then it's their property...

There are laws that punish humans when they harm certain animals such as those endangered, but the laws vary from one country to another because they are tailored to the condition of the ecosystem. I haven't heard of any human who's been given the death penalty for killing a protected species though, as compared to a human killing another human.

As for land, most countries have what we call an "eminent domain" law that allows the government to take a person's land, with due compensation of course, if it is an important or imperative action for the development of an infrastracture in the country.

I think that all animals have the right to be treated properly, just because they're not human doesn't mean they don't have feelings.
I can't believe people can be so cruel to all creatures. Even if they are a mouse.
I read a fact saying that every 6 secons a lab animal dies. Thats absolutely horrific!

All animals should have the same rights as humans, because how are we different to animals. I mean we work, we eat, we breath, we feel. we do almost everything animals do. the only difference is we talk and we look different. But so what? We are related to animals. science has a theory that humans evolved from monkeys/ Apes. so why look at it differently.

Don't confuse rights with the law. Rights can be protected by the law, but it shouldn't be something that is just legal, it should be respected predominantly because that's what's, well, right. That's what I'd like to get across, too. Just a general respect thing. And I think in my other posts it wasn't that clear what I was on about...soz.
